An inmate complained that the DOC Medical Advisory Committee (MAC) had exceeded the allowable time-frame for responding to his medical grievance. The Ombudsman learned that the inmate’s case was reviewed by the MAC, but not because he filed a grievance (he had not), rather, because it was brought for review by a provider. Because there was no grievance, there was no response from the MAC. The substance of the issue was that the inmate did not believe he was receiving adequate treatment and pain medication for his chronic medical condition. The Ombudsman learned that DOC had offered the inmate a treatment plan, including pain medication. The inmate refused this plan because it would have required him to reside in medical segregation so that he could be more closely monitored until DOC was satisfied that the treatment was working. DOC’s decision was reasonable and in accordance with policy, and in light of the inmate exercising his right to waive the medication, there was nothing further the Ombudsman could do for him.
