A citizen alleged that the Department of Public Safety failed to adequately investigate her complaint about the actions of a licensed process server. The Ombudsman reviewed the agency’s file and learned that the complainant’s evidence consisted of second-hand information. The complainant was not at home at the time the process server tried to serve her and failed to provide a statement from the witness in her complaint. In response, the agency obtained a sworn affidavit from the process server and his supervisor, who was also present during the incident, and consulted with the Department of Law before concluding that the process server’s actions were not grounds for discipline or revocation of her license. The agency’s investigation appeared reasonable so the complaint was closed. (A2017-0364)
